Preferred Information for Referrals
The Scottish Government have provided a list of details they would like
to have with each referral, when possible. The list shown below is not
prescriptive and referrals can still be made with partial information.
Only the names of person who occupied child care positions as defined
by Schedule 2 of the Protection of Children (Scotland) Act 2003 may be
referred to Scottish Ministers for consideration for inclusion on the
Disqualified from Working with Children List. The information required
for all referrals is:
Full name, including maiden name and any aliases, of person being referred,
if known.
Date of Birth.
Current address and any previous addresses.
National Insurance Number.
Details of any identity checks which have been carried out to verify
the personal details.
Confirmation that the person occupied a child care post within the meaning
of the Act.
Detailed explanation about the alleged misconduct and how the individual
harmed a child or placed a child at risk of harm.
Details of investigations carried out to date - and their conclusions.
This should include copies of all relevant papers including witness statements,
notes of interviews, minutes of meetings and disciplinary hearings.
Details of the organisation's disciplinary and dismissal procedures.
Details of action taken against the individual - has he or she been
dismissed of transferred from a child care position.
Information on any police involvement or the involvement of any other
agency.
Is the dismissal the subject of an appeal within your organisation or
with an Industrial Tribunal? If so what stage is the appeal at and what
further stages are provided for?
Is the individual engaged in any other work or volunteering involving
contact with children? If so please give details.
