Meeting the legal requirements of the Act?

The Act places your organisation, group or club under a legal duty to do three things:

Refer an individual to the List where the grounds for referral are met.
Not knowingly appoint an individual who is fully listed to a child care position (as defined under Schedule 2 of the Act).
Remove an individual who is fully listed from a child care position.

To help you meet your legal obligations under the Act it will be helpful if you have:

A comprehensive recruitment procedures in place for all workers.
A clear understanding of what is meant by the grounds for referral: thinking about “harm”.
A Code of Conduct which sets out acceptable and unacceptable standards of behaviour.
Procedures for managing grievances and concerns made by, and issues raised by, workers, parents/carers and children and young people.
Arrangements for regular support which allow for any emerging concerns about a worker’s behaviour to be discussed and addressed.
Disciplinary procedures for dealing with continuing serious concerns about a worker’s conduct.
Procedures for making a referral to the List.
Procedures for managing confidential information.
