Background to Training Material

This guidance and training pack was commissioned by the Scottish Executive in order to offer support to the voluntary sector in equipping themselves to meet the requirements of the new Protection of Children (Scotland) Act 2003 which commenced 10th January 2005.

The Scottish Executive issued a general guidance note on the Act entitled Protection of Children (Scotland) Act 2003 – Information Note,(Grey Booklet) Whilst this is still relevant the Scottish Executive have produced a more comprehensive Booklet which includes the same information plus more.

The updated version, Protection of Children (Scotland) Act 2003 – Guidance for Organisations, can be obtained from Blackwells Bookshop by telephoning 0131 622 8283 or 0131 622 8258, alternatively you can access it online it from the Scottish Executive website www.scotland.gov.uk.

The consortium which undertook creating this pack, Children in Scotland, Central Registered Body in Scotland, Scottish Council for Voluntary Organisations, Volunteer Development Scotland and YouthLink Scotland hope that the material will be useful to a wide range of organisations either as a self standing pack or to supplement their own material.

This information pack has been researched and written by Sue Wheatley, freelance consultant and trainer. The consortium would also like to acknowledge the contributions to this process made by a wide range of voluntary organisations.

It is important to note that this is guidance only and not an interpretation of the law which only the courts can provide. However the consortium have obtained access to legal advice to guide you on understanding the full implications of the Act and the guidelines as they stand reflect that advice.

Individuals and organisations should satisfy themselves that the way they implement the Act, whether based on this guidance or not, will meet the requirements of the legislation.
